- "Services" means the loan application and related services provided through our platform
- "Website" means the T&C Loans website and mobile application
3. Eligibility and Application
3.1 Age Requirements
You must be at least 18 years old and a South African citizen or permanent resident to apply for credit through our platform. Proof of identity and age may be required.
3.2 Credit Assessment
All loan applications are subject to credit assessment in accordance with the National Credit Act. We may conduct credit bureau checks and verify your employment and income information.
3.3 Application Process
By submitting a loan application, you warrant that all information provided is true, accurate, and complete. You agree to notify us immediately of any changes to your personal or financial circumstances.
4. Loan Terms and Conditions
4.1 Interest Rates and Fees
Interest rates and fees will be disclosed in your credit agreement. All rates are subject to change and will be confirmed at the time of approval.
4.2 Repayment Terms
Repayment terms, including amounts and due dates, will be specified in your credit agreement. Failure to make payments may result in additional fees and credit bureau listings.
4.3 Default and Recovery
In the event of default, we may exercise our rights under the National Credit Act, including but not limited to debt collection procedures and credit bureau listings.
5. Consumer Rights
Under the Consumer Protection Act 68 of 2008, you have the right to:
- Receive goods or services that are reasonably suitable for their intended purpose
- Receive goods or services of good quality
- Receive goods or services within a reasonable time
- Return goods or cancel services within specified cooling-off periods
- Receive clear and accurate information about goods and services
- Be protected against unfair business practices
6. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy.
By using our services, you consent to the collection and processing of your personal information for the purposes of providing credit services and complying with legal obligations.
7. Electronic Communications
Under the Electronic Communications and Transactions Act 25 of 2002, you consent to receiving communications electronically. This includes loan agreements, statements, and important notices.
You acknowledge that electronic signatures and communications have the same legal effect as written signatures and communications.
8. Limitation of Liability
To the extent permitted by law, our liability for any loss or damage arising from your use of our services is limited. We are not liable for indirect or consequential losses.
Nothing in these Terms excludes or limits our liability for gross negligence, fraud, or willful misconduct.
9. Dispute Resolution
Any disputes arising from these Terms or our services will be resolved through the Consumer Goods and Services Ombud or other appropriate dispute resolution mechanisms.
We encourage consumers to first attempt to resolve disputes directly with us before escalating to external dispute resolution bodies.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any legal proceedings must be instituted in the appropriate South African court.
11. Amendments
We reserve the right to amend these Terms at any time. Material changes will be communicated to you via email or through our website.
